Terms and Conditions of Participation for MODEPALAST 07, Vienna
Registration: Registrations shall be accepted only if they are filed using the online registration form of the organiser. Deadline for registrations is 14th February 2007. All registrations must contain either pictures of the current collection or the URL of a comprehensive homepage. Registrations are only valid after acceptance and admission by the organiser and after payment of the full stand rent fee by 28 March 2007 credited to the account of the organiser. Acknowledgement The registrant/exhibitor acknowledges the Present Terms of Conditions of Participations and the Technical Guidelines issued by the organiser, which shall be binding for the registrant/exhibitor and all people employed by them for the exhibition/fair. All regulations concerning legal regulations as well as employment law and trade law are to be complied with. Admission: The organiser shall decide about admission of the participants. The organiser shall be entitled to reject registrations without giving reasons. Exclusion of competition shall not be acceptable. The binding registration shall be a contract between the exhibitor and the organiser. Admission shall be revoked in case of delay of payment, in which case the registrant must pay 50% of the agreed stand rent. Reservation of Subsequent Contract Modifications: If the fair/exhibition has to be closed as a result of an event of Force Majeure or by the order of authorities, the organiser shall be entitled to claim 50% of the agreed stand rent as a cost contribution. Termination by Exhibitor: Any application of termination shall only be accepted in writing. If the exhibitor is granted by the organiser to rescind upon binding registration, the exhibitor shall pay 50% of the agreed stand rent. Allocation of Stands: The exhibitor provides one size stands. The agreed stand rent shall therefore not be calculated by size but as a flat rate. The award of contracts shall be subject to the organiser. The dates of registration shall not be relevant to the allocation of stands. Subletting, Sale for Third Party: If the organiser agrees the stand to be sublet to any co-exhibitor, the organiser shall be entitled to claim an additional sublease sum of 100.- Euro. The exhibitor shall not be entitled, without the prior consent by the organiser, to sublease the allocated stand, as a whole or in part, or let it otherwise to any third party, or to exchange it. Rents, Costs and Terms of Payment: The stand rents and additional costs are specified in the registration documents. In case of delay of payment, the organiser shall have the right to terminate the contract with immediate effect, if payments, as a whole or in part, are still delayed after a vain reminder and a written warning. Allocation of Stands: The organiser undertakes to allocate the stands with due consideration of the concept and the topic of the fair/exhibition. Every stand is equipped with one or two clothes rails as well as some racks for exhibition space. The individual furnishing of the stand with the exhibits is subject to the exhibitor and must be completed two hours before opening of the exhibition. All materials used to furnish the stand must be of low flammability. Setup of Stands: No stand shall be cleared prior to the end of the exhibition. In case of violation of this rule, the organiser shall be entitled to claim 50% of the agreed stand rent as a contract penalty. Clearance shall take place within the agreed Time of Clearance (on Sunday 15th April 2007 after the closing of the fair or on Monday, 16th April, 10am - 12am). The exhibitor is subject to damage to and in the exhibition area. Running a Stand: The exhibitor shall be obliged to equip the stand with competent staff for the whole period of the fair/exhibition. The exhibitor shall clear the stands daily after the closing of the exhibition. The organiser shall be responsible for the clearance of the exhibition halls and the final clearance. Guarding: The exhibitor shall be responsible for guarding and attending their own stand. Guarding shall start on the first setup day and end on the last day of dismantling. The exhibition venue will be locked overnight. The organiser takes no liability for exhibits remaining in the venue overnight. Liability: The organiser shall only be liable for property damage and bodily injury within statutory liability. The organiser shall not be liable for damage to fair/exhibition articles, the equipment of the stand as well as consequential damage. The exhibitors are strongly advised to take out insurance cover for their exhibits and stands. Supplements and Amendments: Any derogation from these Terms and Conditions of Participation shall be made in writing to become effective. Place of Performance and Jurisdiction: The Place of Performance and Jurisdiction shall be Vienna. |
